Tienes derecho a apelar (Guion 2).

  1. Do NOT throw it away or "save it for later." Benefit letters carry deadlines, and the clock starts on the date printed on the letter.
  2. Find three things: WHAT was decided (approved, denied, reduced, ended) · STARTING WHEN (the date the change takes effect) · UNTIL WHEN can I respond (your appeal deadline).
  3. If something is unclear, you are NOT required to guess: you have the right to a free explanation in your language. Call the number on the letter or 2-1-1 and say: "I need this information in [your language]."
  4. Keep the letter AND the envelope. The deadline counts from the date on the letter, but the envelope proves when it reached you.
  5. If the decision seems wrong: it is NOT the final word. You have the right to appeal (Script 2).

No cuesta nada.
English

0. First, two truths nobody prints that change everything:

  • Appealing is not fighting or being disrespectful. It's a NORMAL process the system itself provides to correct its errors. Workers expect it; no one will hold it against you.
  • Appealing is not an immigration procedure and it is not a complaint against anyone. It is part of the same program that gave you the benefit, and appealing creates no risk that does not already exist from receiving the benefit. What you should know, without fear and without rumors: the federal "public charge" rules changed on September 18, 2026. They do not apply to citizens, to becoming a citizen, to renewing a green card, or to refugees, asylees and U or T visa holders, among others. But if you or someone in your home will be applying for a green card or a visa, receiving certain benefits from that date on may be taken into account. Before giving up a benefit, or giving up an appeal, out of fear, get free advice from an immigration lawyer or an accredited organization (Script 5). Decide with information, not with fear.
  1. An HHSC decision can be appealed. It's called a "fair hearing": an officer who did NOT take part in the decision reviews your case.
  2. GENERAL DEADLINE: you have 90 days, counted from the date on the letter or from the date the change takes effect, whichever is later. If the decision came from your health plan and not from HHSC, you appeal with the plan first; after that you have 120 days to request the state fair hearing. If you missed the deadline, request it anyway and explain why: the officer decides whether your reason counts.
  3. THE GOLDEN DEADLINE: if you request the hearing within 13 days of the date on the letter (or before the change takes effect), you can ask for your benefits to CONTINUE while your case is decided. Say exactly: "I want to appeal, and I want my benefits to continue while the appeal is pending." Note: if you lose in the end, you may be asked to pay back what you received in the meantime. Continued benefits are your choice.
  4. How: call 2-1-1 or 877-541-7905 (pick your language, then press 2), go in person to an HHSC office, or request it in writing. There is no cost. You don't need a lawyer: you can go alone, with a relative or friend representing you, or with a lawyer at your own expense. If you need an interpreter at the hearing, ask the hearing officer beforehand: it's free.
  5. Write down: date of your call, name of the person, confirmation number. No record, no proof. Hearings are almost always by phone, and the decision can take up to 90 days (60 for SNAP).
Guion 3: Voy a llamar a HHSC, qué decir y qué anotar. Script 3: I'm calling HHSC, what to say and what to write down.

BEFORE calling, have ready: your letter, your case number, your ID. The benefits line (2-1-1 or 877-541-7905, language then 2) is open Monday to Friday, 8 AM to 6 PM.

DURING the call, always ask for and write down: worker's name · date and time · call reference number.

Phrases that work:

  • "Can you explain exactly why this decision was made?"
  • "What document is missing, and what is the deadline to submit it?"
  • "Can you give me the reference number for this call?"

Answers you should NOT simply accept: "Call another day" (get the reference number anyway) · "There's nothing you can do" (there almost always IS: appeal, review, reapplication, Script 2).

AFTER: keep your notes with the letter. Every documented call is evidence in your favor.

English
  1. First: appeal NOW if you're within the deadline (Script 2), asking for continued benefits if still possible.
  2. Do NOT stop taking your medications without talking to your doctor. Tell your clinic: "I lost my coverage. Are there samples, manufacturer programs, or alternatives while I resolve this?"
  3. Bridges while it's resolved: manufacturer patient assistance programs · low-cost community clinics (sliding scale) · in Harris County, the Harris Health Financial Assistance Program: for residents with income up to 150% of the federal poverty level, no fee to apply, and their pharmacy enrolls you in manufacturer programs. 4. Before deciding anything, call HICAP at 800-252-9240: free, unbiased counseling, no sales.
  5. Keep ALL receipts for anything you pay out of pocket while the problem lasts. If you win your appeal, your coverage is restored back to the date of the error, and any clinic or pharmacy that accepts Medicaid for that period must refund what you paid and bill Medicaid instead. It is not automatic: you ask, receipts in hand.
